Hold Harmless Agreement for Participation in Activities and/or Use of District Facilities The primary purpose for the use of schools, athletic facilities and related buildings is for the education and benefit of Marsh Valley School District #21 ("District") students. The use of District facilities by third parties exposes the District to possible liabilities. This agreement provides assurance to the District that third parties agree to accept the risks of use of District facilities and to indemnify and hold the District harmless in case of claims arising out of such use.
1. INDEMNITY. The undersigned applicant for use of District facilities agrees to indemnify and hold harmless Marsh Valley School District #21, all of its officers, agents and employees, from any loss or damage, liability or expense that may arise during, or is in any way caused by, the undersigned's use or occupancy of District facilities.
2. INSURANCE. The undersigned acknowledges that the District does not provide additional health or other insurance for the use of District facilities by third parties, including the undersigned. The undersigned further agrees that in the event of any injury to him/her, or his or her minor child during the activity or use of District facilities, any claims for such injury or damage will be made to the undersigned's personal insurance carrier.
3. ASSUMPTION OF RISK AND RELEASE. The undersigned acknowledges that some activities occurring on District property or in District facilities involves known and unknown dangers and/or risks, and grant a general release for himself/herself, his/her heirs, executors, administrators and assigns, and waive, release and forever discharge and hold harmless the Marsh Valley School District #21, its officers, agents and employees, from any claims, suits or damages which might result from the undersigned's participation, or the participation of the minor child/ren of the undersigned in the event/s on District property or in District facilities.
